В статье анализируется роль и место государства в формировании и обеспечении деятельности правозащитного механизма, элементы которого во многом представлены собственно государственными органами и той нормативной правовой основой, которая делает этот механизм действенным и эффективным, переводит статику правовой охраны в динамику правовой защиты.
